IIOBC determines man who got injured while in Okanagan jail cell was not hurt because of police

The Independent Investigations Office of BC has concluded an investigation into a man who was injured while in police custody in the Okanagan.

According to IIO Chief Civilian Director Ronald McDonald, the man's injuries were not the result of police action or inaction. The decision comes after the director reviewed statements from witnesses, CCTV footage and the affected person's medical information.

This incident occurred on Sept. 21 in Penticton, just after 7:10 pm. On that day, a caller reported seeing a man in their yard at a home in the 90-block of Okanagan Avenue East.

After locating the man, police noticed he was causing a disturbance. The man was then transported to RCMP detachment cells.

At 3:45 am the following day, the man's cell showed that he fell from a seated position, which resulted in him striking a sink next to him. shortly after this, the man went into medical distress and was transported to a local hospital.

There was no evidence that officers used excessive force at any time during the incident. The man would be transferred to a larger hospital for further treatment.

He eventually recovered well enough to leave the hospital, though it was against medical advice.
